License Agreement

1. License Grant

Subject to your compliance with this License Agreement and our Terms of Service, Name Tattoo Design grants you a personal, non-exclusive, non-transferable license to use the AI-generated tattoo designs you create through our platform.

This license is effective from the moment you generate a design and download it from our platform.

2. Permitted Uses

You are granted the following rights for designs you generate:

• Personal Use: Use the design for your own tattoo
• Tattoo Implementation: Provide the design to a licensed tattoo artist for implementation
• Modification: Modify or adapt the design for your personal tattoo needs
• Sharing: Share the design with your chosen tattoo artist
• Portfolio Use: Tattoo artists may include the final tattoo in their portfolio with proper attribution

3. Restrictions

The following uses are strictly prohibited:

• Commercial Resale: Selling or licensing the designs to third parties
• Mass Distribution: Distributing designs through websites, apps, or other platforms
• Trademark/Copyright Claims: Claiming ownership or registering trademarks based on the designs
• Competing Services: Using designs to create competing tattoo design services
• Reverse Engineering: Attempting to recreate our AI technology using the designs
• Offensive Use: Using designs for hate speech, discrimination, or illegal activities

4. Design Ownership and Rights

4.1 Generated Designs

While you receive usage rights to designs you generate, the underlying AI technology and algorithms remain the exclusive property of Name Tattoo Design.

4.2 Similar Designs

You acknowledge that our AI may generate similar or identical designs for other users based on similar inputs. This license does not grant you exclusive rights to any particular design concept or style.

4.3 User Input

You retain ownership of any original text, names, or concepts you input into our system. However, you grant us a limited license to use this input solely for generating your requested designs.

5. Quality and Suitability

5.1 Design Quality

While we strive to provide high-quality designs, we make no warranties regarding the artistic merit, technical accuracy, or suitability of generated designs for tattoo implementation.

5.2 Professional Consultation

We strongly recommend consulting with a professional tattoo artist before implementing any design. Tattoo artists may need to modify designs for optimal results based on skin type, placement, and technical considerations.

5.3 Health and Safety

This license does not include any health or safety guarantees. Always ensure your chosen tattoo artist follows proper health and safety protocols.

6. Attribution Requirements

6.1 Personal Use

No attribution is required for personal tattoo use.

6.2 Professional Portfolio

Tattoo artists including the final tattoo in their portfolio should include attribution: "Design created with Name Tattoo Design AI" when possible and appropriate.

6.3 Social Media Sharing

When sharing your tattoo on social media, we appreciate (but do not require) mentions of @NameTattooDesign or #NameTattooDesign.

7. License Duration and Termination

7.1 Duration

This license is perpetual for designs you have legitimately generated and downloaded, subject to your continued compliance with these terms.

7.2 Termination

This license may be terminated if you violate any terms of this agreement or our Terms of Service. Upon termination, you must cease all use of the designs except for tattoos already implemented.

8. Disclaimers

THE DESIGNS ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the designs will be error-free, meet your requirements, or be suitable for tattoo implementation without modification.

9. Limitation of Liability

IN NO EVENT SHALL NAME TATTOO DESIGN BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE DESIGNS, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, OR DATA.

Our total liability shall not exceed the amount you paid for the credits used to generate the specific design in question.

10. Governing Law

This License Agreement shall be governed by and construed in accordance with the laws of the jurisdiction where Name Tattoo Design operates, without regard to conflict of law principles.

11. Changes to License

We may update this License Agreement from time to time. Changes will not affect designs already generated under previous versions of this agreement. New designs will be subject to the current version of the license.
